These Terms of Service ("Terms") form a binding agreement between you and M3CA Ltd, a company registered in England and Wales (company number 14988231) trading as M3CATalent. By creating an account or using the platform you agree to be bound by these Terms.
1. The service
M3CATalent is an online marketplace that connects employers with verified talent for short term and project based work in the UK. We are not the employer of record for any booking unless explicitly agreed in writing as part of an Employer of Record add on.
2. Accounts
You must be at least 18 years old, provide accurate information, keep your password secure, and notify us immediately of any unauthorised access. You are responsible for activity on your account.
3. Bookings and payments
Employer funds are held in escrow on booking confirmation and released to talent automatically when the shift is marked complete. Platform fees are deducted from the employer side only. Talent always keep 100 percent of the agreed rate. All fees are stated in our Pricing page and at the point of booking.
4. Cancellations
Free cancellation by either party up to 24 hours before the shift start time. Late cancellations may incur a fee equal to the first hour of the booking, paid to the affected party.
5. Conduct
Discriminatory, harassing, unsafe, fraudulent, or off platform circumvention behaviour leads to immediate account termination and possible legal action. We reserve the right to refuse service.
6. Insurance
On the job accident and public liability insurance is included for talent during confirmed bookings, subject to the policy schedule available at /trust. Insurance does not extend to off platform work.
7. IR35 and tax
Employers are responsible for status determinations under the Off Payroll Working rules where applicable. Talent are responsible for declaring income to HMRC. We provide tooling and records to support both.
8. Liability
Our aggregate liability to you for any claim arising from these Terms is limited to the fees you paid or received in the 12 months preceding the claim. We do not exclude liability for death, personal injury caused by our negligence, or fraud.
9. Termination
Either party may terminate this agreement at any time by closing the account. Outstanding bookings and payment obligations survive termination.
10. Governing law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute.
11. Changes
We may update these Terms. Material changes will be notified by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
